Lam, Joseph The resignation of Pope Benedict XVI caught the world by surprise, in spite the fact that he had earlier indicated this possibility. In a series of interviews that were published in 2011 as a book by the German journalist Peter Seewald, Benedict clearly stated: If a pope clearly realizes that he is no longer physically, psychologically and spiritually capable of handling the duties of his office, then he has a right and, under some circumstances, also an obligation to (...) resign. Over the past decade AIDS research has turned toward the use of pharmacology in HIV prevention, including pre-exposure prophylaxis (PrEP): the use of HIV medication as a means of preventing HIV acquisition in those who do not have it. This paper explores the contradictory reasons offered in support of PrEP—to empower women, to provide another risk-reduction option for gay men—as the context for understanding the social meaning of the experimental trials that appear to show that PrEP works in gay men (...) and heterosexual couples but not single women. The PrEP debates reveal the different ideas about “demedicalization” in the earlier gay health and women’s health movements and highlight the relationship between health activism and critique of research ethics in the context of a global pharmaceutical market. Lam, Joseph Peter Fitzsimons is a competent journalist who does not shy away from expressing his personal opinion on controversial social and ethical issues. In a Sydney Morning Herald online comment published on 11 December 2016, he not only praised the courage of the premier of Victoria, Daniel Andrews, but also appealed to members of the New South Wales parliament to follow Andrews' lead to legalise euthanasia. Anticipating the eventual collapse of his own health in the future, Fitzsimons insisted that (...) lawmakers should respect his autonomy and his choice of a peaceful and dignified death. As far as I can see, however, respect for a person's autonomy is not the main problem here. Rather, the key difficulty rests with Fitzsimons's reasoning. He argued: Let's say that at the age of 80 or so, I decide that my meaningful life is over, and all that awaits me is-I know, I know, too much detail- incontinent pain for the next five years. And let's say that I don't want that, and would rather pass away peacefully, and with dignity, in a medically supervised manner. My question to the opponents of euthanasia: if I choose to do that, what business is it of yours? (shrink)

The paper argues that there are structures rather than objects with an intrinsic identity in the domain of fundamental physics. We line out the standard metaphysics of objects with an intrinsic identity, recall the main objection against that position (section 1) and then retrace the development to epistemic structural realism (section 2) and to ontic structural realism (section 3). We elaborate on the arguments for ontic structural realism from quantum physics (section 4) and from space-time physics (section 5). It is the praxis of being a subject in the world which enables psychoanalysis to theorise subjectivity. Freud theorised subjectivity from the perspective of desires, those repressed unconscious forces which conflict with the subjects’ need to live in the world. The upshot of this conflict for the subject is trauma and for psychoanalysis such trauma provides a way into a remedy, a cure, the presumption of psychoanalysis being that through its method of transference, it does indeed possess the knowledge to (...) pursue a remedy. Lacan offers a new interpretation of Freud by considering the subject as an ongoing ontological enigma in so far as subjective unconscious desire is not only (potentially) traumatic but necessarily (always) linguistic. How is this an ontological enigma? For Lacan the subject is first and foremost a speaking being engaged in an ongoing struggle to articulate unconscious desire. This is because, claims Lacan, we are born into language which not only pre-exists us but continues after death. In this way subjectivity is inescapably oriented to language as simultaneously intrinsic external to it. The unconscious is therefore a mixture of inside and outside, an enigmatic (pre)ontological space which Lacan calls extimacy. This essay seeks to explore Lacan’s orientation of the subject towards extimacy as the site of subjective conflict where, in its quest for the subject’s desire to know and handle the symptom, transference engages a new ontological dimension in which we can say that the extimate is structured like a sensation. Most political philosophers are reluctant to treat cultural rights as basic. Instead, the predominant view is that cultural interests are only important derivatively, in virtue of their contribution to some other interest. In this chapter I argue that political philosophers ought to follow international human rights norms regarding the importance of culture. Not only do international human rights courts and committees come to the right conclusion about the significance of culture, but, as importantly, they come to this conclusion because they (...) think about what cultural rights protect inthe right way. Contemporary political philosophers prefer to treat cultural rights as derivative in part because they tend to treat culture as a “resource” or a “good,” but this is a mistake. Cultural rights are better understood as protecting and promoting an activity. Respecting and promoting cultural participation is a constitutive element of showing respect for human dignity because, like free expression, political participation, and freedom of conscience, cultural participation is something persons do as part of making a life for themselves. A popular strategy for answering the question of why and how laws bind is to use the concept of political justification: to argue that laws bind when they can be justified in the political domain. Being defensible in the political domain is supposed to make laws emotionally compelling in virtue of their being justified for each member of the community, and intellectually compelling in virtue of their having emerged from a process that is subject to constraints of rationality such as (...) consistency and coherence. However, being politically justifiable does not and cannot explain why it is reasonable to expect individuals to conform because it places too much emphasis on deference to the judgments of public actors. In this paper I use a distinction between general availability and general acceptability accounts of publicity to explain why the answer to what makes laws binding lies in developing an account of good reasons, not an account of why political reasons should take priority. CTN, Ann Arbor�s community access cable TV station, is run by the city but not paid for by tax dollars. It is one of the first public access cable stations in the U.S., founded in 1973.

At the turn of the nineteenth century when anatomy and hands-on dissection became the prerequisite for a medical career, the medical community in England and France increasingly relied upon visual representations as part of a complex system of reinforcement of their professional goals. The production of novel illustrated textbooks that disseminated arguments through systematizing illustrations were thus integral to their professional status. Through an examination of a series of realistic diagrams that outlined the new methods of surgical and preservation techniques, (...) this paper argues that visual diagrams were instrumental in supporting the systematic codification and prestige on which nineteenth-century medical knowledge was to depend. It analyses the visual rhetoric and the complex representational languages of these intricate and equally precise illustrations by asking how these illustrations embraced new representational strategies as well as embodied idealizing aesthetic techniques. Die Möglichkeit, Walter Benjamins Allegorie-Begriff in akademischen Untersuchungen mit der Prosa Jean Pauls in Verbindung zu bringen, wurde von Benjamin noch selbst abgewogen: in der Rezension einer frühen Abhandlung zu diesem Thema, die er für zu kurz gegriffen befand. Ein solches Vorhaben, das beste Chancen böte, dürfe sich nämlich nicht auf literaturwissenschaftliche und geistesgeschichtliche Perspektiven beschränken. Notwendig sei vielmehr, auch die Dimension der Alltagskultur einzubeziehen und Jean Pauls Hinabgreifen in Tiefen des Volkstums und der Tradition zu berücksichtigen. Diesem Hinweis Benjamins (...) folgt die vorliegende Untersuchung. Indem sie sich auf den Bereich der materiellen Kultur konzentriert, legt sie eine Geschichte der Theorie der Dingwelt offen. Jean Pauls ästhetische Überlegungen zur projektiven Belehnung der Dingwelt mit seelischen Regungen wurden von Aby Warburg aufgegriffen und für seine kulturwissenschaftliche Methode fruchtbar gemacht. Dabei erschliesst er unter anderem einen Traditionsstrang des Denkens von materieller Kultur im ästhetischen und kultur anthropologischen Kontext, der geprägt ist von aus der Antike herrührenden abergläubischen Vorstellungen über die Einflüsse der Planeten auf die menschliche Geistesverfassung wie etwa die Saturnfürchtigkeit. Why is it that we sometimes think of Lacan as Marxist when he is so assertive in being Freudian? Perhaps it is because Lacan perceives Marx rather than Freud as the discoverer of the symptom and furthermore places Marx as central to his fifth Capitalist discourse, in contrast with his previous discourses which are all inspired by Freud. This article considers how Lacan’s final and arguably unfinished Capitalist discourse stands apart from all the others, yet at the same time it (...) reveals contradictions and possible parallels with them as it attempts to unravel the dialectical tensions between the problematic production and consumption of meaning. The procedures of canonical quantization of the gravitational field apparently lead to entities for which any interpretation in terms of spatio-temporal localization or spatio-temporal extension seems difficult. This fact is the main ground for the suggestion that can often be found in the physics literature on canonical quantum gravity according to which spacetime may not be fundamental in some sense. This paper aims to investigate this radical suggestion from an ontologically serious point of view in the cases of two standard (...) forms of canonical quantum gravity, quantum geometrodynamics and loop quantum gravity. We start by discussing the physical features of the quantum wave functional of quantum geometrodynamics and of the spin networks of loop quantum gravity that motivate the view according to which spacetime is not fundamental. We then point out that, by contrast, for any known ontologically serious understanding of quantum entanglement, the commitment to spacetime seems indispensable. Against this background, we then critically discuss the idea that spacetime may emerge from more fundamental entities. As a consequence, we finally suggest that the emergence of classical spacetime in canonical quantum gravity faces a dilemma: either spacetime ontologically emerges from more fundamental non-spatio-temporal entities or it already belongs to the fundamental quantum gravitational level and the emergence of the classical picture is merely a matter of levels of description. On the first horn of the dilemma, it is unclear how to make sense of concrete physical entities that are not in spacetime and of the notion of ontological emergence that is involved. The second horn runs into the difficulties raised by the physics of canonical quantum gravity. (shrink)

Cultural narratives shape how we think about the world, including how we decide when the end of life begins. Hospice care has become an integral part of the end‐of‐life care in the United States, but as it has grown, its policies and practices have also imposed cultural narratives, like those associated with the “six‐month rule” that the majority of the end of life takes place in the final six months of life. This idea is embedded in policies for a range (...) of care practices and reimbursement processes, even though six months is not always a meaningful marker. In the case of people living with advanced dementia, six months is both too early in the trajectory to facilitate conversations and too late in the trajectory to ensure decision‐making capacity. This essay encourages scholars and policy‐makers to consider how cultural narratives may limit what they think is possible in care for people living with dementia. (shrink)

This paper critically discusses recent objections that have been raised against the contextual understanding of fundamental physical objects advocated by non-eliminative ontic structural realism. One of these recent objections claims that such a purely relational understanding of objects cannot account for there being a determinate number of them. A more general objection concerns a well-known circularity threat: relations presuppose the objects they relate and so cannot account for them. A similar circularity objection has also been raised within the framework of (...) the weak discernibility claims made in the last few years about quantum particles. We argue that these objections rely either on mere metaphysical prejudice or on confusing the logico-mathematical formalism within which a physical theory is formulated with the physical theory itself. Furthermore, we defend the motivations for taking numerical diversity as a primitive fact in this context. (shrink)

Theories of quantum gravity generically presuppose or predict that the reality underlying relativistic spacetimes they are describing is significantly non-spatiotemporal. On pain of empirical incoherence, approaches to quantum gravity must establish how relativistic spacetime emerges from their non-spatiotemporal structures. We argue that in order to secure this emergence, it is sufficient to establish that only those features of relativistic spacetimes functionally relevant in producing empirical evidence must be recovered. In order to complete this task, an account must be given of (...) how the more fundamental structures instantiate these functional roles. We illustrate the general idea in the context of causal set theory and loop quantum gravity, two prominent approaches to quantum gravity. (shrink)

Background Current requirements for ethical research in Canada, specifically the standard of active or signed parental consent, can leave Indigenous children and youth with inequitable access to research opportunities or health screening. Our objective was to examine the literature to identify culturally safe research consent processes that respect the rights of Indigenous children, the rights and responsibilities of parents or caregivers, and community protocols. Methods We followed PRISMA guidelines and Arksey and O’Malley’s approach for charting and synthesizing evidence. We searched (...) MEDLINE, PsycINFO, ERIC, CINAHL, Google Scholar, Web of Science, Informit Indigenous Collection, Bibliography of Native North Americans, and Sociological Abstracts. We included peer-reviewed primary and theoretical research articles written in English from January 1, 2000, to March 31, 2022, examining Indigenous approaches for obtaining informed consent from parents, families, children, or youth. Eligible records were uploaded to Covidence for title and abstract screening. We appraised the findings using a Two-Eyed Seeing approach. These findings were inductively coded using NVivo 12 and analyzed thematically. Results We identified 2,984 records and 11 eligible studies were included after screening. Three key recommendations emerged: addressing tensions in the ethics of consent, embracing wise practices, and using relational approaches to consent. Tensions in consent concerned Research Ethics Board consent requirements that fall short of protecting Indigenous children and communities when culturally incongruent. Wise practices included allowing parents and children to consent together, land-based consenting, and involving communities in decision-making. Using relational approaches to consent embodied community engagement and relationship building while acknowledging consent for Indigenous children cannot be obtained in isolation from family and community. Conclusions Very few studies discussed obtaining child consent in Indigenous communities. While Indigenous communities are not a monolith, the literature identified a need for community-driven, decolonized consent processes prioritizing Indigenous values and protocols. Further research is needed to examine nuances of Indigenized consent processes and determine how to operationalize them, enabling culturally appropriate, equitable access to research and services for all Indigenous children. In a recent paper, Michael Levin argues that both statements reporting causal relations and causal explanatory statements are extensional. We show that his argument for the extensionality of causal explanatory statements fails to establish that conclusion. His claim that certain 'because' statements are elliptical for statements of what he terms the 'causal explanatory' form is unsubstantiated. The argument for the referential transparency of the allegedly explanatory form, regardless of whether it is a distinct explanatory form, fails because of scope problems. (...) Finally, we argue that the apparent referential opacity of explanations, the attribution of certain kinds of properties to explanations, and our satisfaction with explanations in what appear to be disparate forms are best accounted for, not by the assumption of ellipticality of statements in various forms for statements in some inherently explanatory form, but rather by an account of explanation as a speech act, the success or failure of which may be affected by which of several co-referring expressions is employed. Breastfeeding remains an understudied topic in research and theorizing about reproductive experience and women's bodies. This article reports on women's experiences of breastfeeding in public as revealed through in-depth interviews with 51 women. The current construction of the good maternal body requires women to carefully manage the performance of breastfeeding in specific ways and with particular attention to the dominant notion of a sexualized rather than nurturing breast. Women accommodate to, and resist, the perceived boundaries of the good maternal body (...) through their breastfeeding behaviors. (shrink)

Large-scale and discontinuous rapid transitions in the climate and Earth systems constitute one of the most concerning, yet in many ways one of the least understood aspects of climate change. On the one hand, because of their potential huge impacts on human and ecological systems, it is argued that climate tipping points and their interactions (potentially leading to cascading effects) help “to define that we are in a climate emergency.” On the other hand, it is largely acknowledged that making quantitative (...) (e.g., probabilistic) statements about abrupt climate changes and tipping points is extremely challenging. Some form of tension thus emerges from these two sides of abrupt climate changes and underlies the development of the very notion of climate tipping point. This tension finds its roots in the many epistemic and methodological issues that arise in the context of abrupt climate changes and tipping points. This contribution aims to provide an overview of these issues in a philosophy of science perspective; the expectation is that such a conceptual perspective can help to improve our understanding of the specific challenges related to abrupt climate changes and tipping points. The practice of placing men and women in the same hospital room (mixed gender rooms) has been prohibited in the UK National Health Service for over a decade. However, recent research demonstrates that the practice is common and increasing in a major New Zealand public hospital. Reports and complaints show that the practice also occurs in Australia. We argue that mixed gender rooms violate the fundamental human rights of personal security and dignity. The high rates of cognitive impairment, sensory impairment (...) and frailty in hospital wards exacerbates the risk for these violations and subsequent harm. We argue for the adoption of specific national policies prohibiting mixed gender rooms and public reporting of breaches. Importantly, these guidelines can be adopted without compromising the rights of gender minorities. In the long term, hospitals should be built with single occupancy rooms. (shrink)

Robert Card argues that although Susan Okin’s analysis in Justice, Gender and the Family leads to the conclusion that justice within the family requires elimination of gendered roles within marriage, this conclusion is not compatible with a conception of justice in which neutrality between reasonable conceptions of the good, and protection of individuals’ contractual capabilities are taken to be fundamental values. Although Card is right that there is tension in Okin’s work between where the analysis of injustice within the gender-structured (...) family leads and where, as a reformer, Okin is willing to go, and he is right to locate the source of that tension in Okin’s attempt to remain within Rawlsian liberalism, Okin’s view has more resources to respond to this critique than Card acknowledges. In the end, these additional resources may not be sufficient to address the problems that Card notes, but they do suggest a more complex relationship between Okin’s view and the liberal tradition than Card allows.. In THE CONSTITUTION OF EQUALITY, Thomas Christiano takes on the question of why decisions that have been democratically arrived at should be treated as authoritative even if we do not agree with them. A key element of that argument is the concept of a “common world”. Christiano takes the connections between people produced by subjection to the same state as the paradigmatic case of a common world, and seems to assume that state-based common worlds take normative priority over common-world-like connections (...) produced by other social and institutional structures. This identification of the worlds created by states and other groupings is not necessary to the function that common worlds perform in Christiano’s argument, and there are good reasons for resisting such identification. These reasons become most apparent when we consider that the problems that minorities within a state face typically reflect ongoing injustice in the terms of their incorporation into the common world produced by the state that encompasses them. States’ capacities to produce and maintain common worlds depends on an international institutional context that accepts and reinforces exclusive jurisdiction with respect to a territory and population. This international context raises several questions: whether state-based groupings ought to be privileged in this way; how boundaries must be drawn for such privilege to be defensible; and what the proper relationship is between decisions by state-based and other groupings. The Constitution of Equality offers interesting resources for grappling with these questions. But we must be willing to think beyond the state. (shrink)

In Global Justice: A Cosmopolitan Account Gillian Brock makes three important claims: that we have duties of justice to all human beings and not only those with whom we share a state; that our duties to those outside our states are of the same scope and normative weight as our duties to those with whom we share a state; and that the existing framework of international institutions affords us a number of straightforward and accessible means to act on our duties (...) to persons outside our states that we ought to pursue. These claims are important in themselves, but the real interest of Brock’s book lies with the argumentative strategy she uses in support of them. This strategy, which includes emphasizing the compellingness of specific institutional and policy prescriptions and distancing her arguments from debates about the structure and plausibility of Rawlsian internationalism, bears interesting fruit in a number of respects. However, it also raises difficult questions about the coherence of the distinction between cosmopolitanism and nationalism on which Brock relies, and about the value of institutionalist approaches to justice more generally.
